To be granted a divorce in Australia, the court must be satisfied that your relationship has broken down irretrievably. A couple must have undergone a separation period of 12 months in order to prove their separation. In some cases, a couple that is separated but still living together is still able to prove that they are no longer in a relationship and apply for divorce.
Divorce is usually granted approximately three months after the date you file your application. Once you have filed for divorce, the court will provide a hearing date. After a divorce is granted by the court, it becomes final one month and one day after that date.
